By accessing or using NumberFlag ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service. 2. Description of service

NumberFlag is a community-powered phone number lookup platform. Users can search for phone numbers and submit reports about calls they have received. The Service aggregates these reports to generate risk scores and caller reputation data.

The Service is provided free of charge. We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice, and without liability to you.

3. No warranty — "as is" disclaimer

THE SERVICE AND ALL INFORMATION, CONTENT, DATA, RISK SCORES, REPORTS, AND MATERIALS PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT.

Without limiting the foregoing, NumberFlag makes no warranty or representation that:

• Any information on the Service is accurate, complete, reliable, current, or error-free
• Risk scores or safety ratings reflect the true nature of any phone number or caller
• A number flagged as spam or scam is actually spam or scam (false positives may occur)
• A number not flagged is safe (false negatives may occur)
• Phone number ownership or assignment has not changed since a report was submitted
• The Service will be uninterrupted, timely, secure, or free of errors

4. No reliance — use at your own risk

You acknowledge and agree that any reliance on information provided through the Service is entirely at your own risk. The information onNumberFlag should not be used as the sole basis for any decision, including but not limited to whether to answer, return, or block a phone call.

NumberFlag is not responsible for any actions you take or fail to take based on information obtained through the Service, including but not limited to financial loss, missed calls, blocked legitimate callers, or interactions with fraudulent callers.

5. User-generated content

NumberFlag allows users to submit reports and comments about phone numbers ("User Content"). You understand and agree that:

• User Content is submitted by third-party users, not by NumberFlag. We do not verify, endorse, or guarantee the accuracy of any User Content.
• NumberFlag is a platform, not a publisher. We act as a neutral intermediary and are not responsible for any User Content posted on the Service.
• We reserve the right, but have no obligation, to monitor, review, edit, or remove any User Content at our sole discretion, for any reason or no reason, without notice.
• We have no duty to pre-screen, verify, or investigate any report before it is displayed on the Service.

6. Your submissions

By submitting a report or any other content to NumberFlag, you:

• Grant NumberFlag a perpetual, irrevocable, worldwide, royalty-free, transferable license to use, reproduce, modify, adapt, publish, distribute, and display your submission in any media or format.
• Represent that your submission is truthful to the best of your knowledge and does not violate any law or third-party right.
• Accept that submissions are final and generally cannot be retracted or deleted upon request.
• Are solely responsible for the content of your submission.NumberFlag bears no liability for any claims arising from your submission.

7. Prohibited conduct

You agree not to:

• Submit false, misleading, or defamatory reports
• Post personal information of individuals (doxxing), threats, or harassment
• Use the Service for any unlawful purpose
• Attempt to manipulate risk scores or game the reporting system
• Scrape, crawl, or harvest data from the Service by automated means without prior written consent
• Interfere with or disrupt the Service or its infrastructure
• Impersonate any person or entity
• Use the Service to harass, stalk, or intimidate any individual

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALLNumberFlag, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE
• ANY INFORMATION OR CONTENT OBTAINED FROM THE SERVICE
• ANY USER CONTENT POSTED ON THE SERVICE
• ANY ACTIONS TAKEN OR NOT TAKEN BASED ON INFORMATION FROM THE SERVICE
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• ANY OTHER MATTER RELATING TO THE SERVICE

THE TOTAL LIABILITY OF NumberFlag FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ZERO DOLLARS ($0.00). THIS IS A FREE SERVICE AND YOU ACKNOWLEDGE THAT THIS LIMITATION OF LIABILITY IS A FUNDAMENTAL CONDITION OF YOUR USE.

9. Indemnification

You agree to indemnify, defend, and hold harmless NumberFlag, its owners, operators, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your submissions or User Content
• Your violation of these Terms
• Your violation of any law or any third party's rights

10. DMCA and copyright

If you believe that content on NumberFlag infringes your copyright, you may submit a DMCA takedown notice. Your notice must include:

• Identification of the copyrighted work
• Identification of the infringing material and its location on the Service
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf

We will respond to valid DMCA notices and may remove or disable access to infringing material. Repeat infringers may be permanently banned from the Service.

11. Termination

We reserve the right to restrict, suspend, or terminate your access to the Service at any time, for any reason or no reason, without notice or liability. This includes the right to block IP addresses, remove content, and ban users who violate these Terms.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and NumberFlag regarding the Service and supersede all prior agreements and understandings.
